چکیده

تأویل نحوی آیات قرآن و تفاوت در وجوه نحوی، از مباحثی است که همواره موجب اختلاف نظر در استنباط احکام فقهی، و اختلاف در دریافت و فهم مفسران، مترجمان و فقها از آیات قرآن شده است. در این نوشتار برمبنای تأویل نحوی آیات و استناد به وجوه نحوی قابل اعتناء، به بررسی آیات الاحکام پرداخته می شود و با نگاهی تحلیلی-توصیفی امکان دریافت استنباط جدید از احکام فقهی مورد بررسی قرار می گیرد. و با پاسخگویی به این پرسش که آیا بر مبنای تأویل نحوی، می توان برداشت فقهی جدیدی از آیات الاحکام استنباط نمود، دیدگاه های متفاوت مورد کنکاش قرار گرفته است. و نتیجه آنکه در برخی از این آیات، اختلافات مطرح شده از سوی نحویان گرچه که در موارد جزئی می باشد ولی به قدری مهم است که کاملاً حکم فقهی هر فقیه با هم صنف خودش فرق می کند و در بخش دیگری از آیات، اختلاف فقط در تعابیر مطرح شده از سوی نحویان می باشد که در اعمال و واجبات عبادی تأثیر بسزایی ندارد. به عبارتی همه فقیهان یک حکم را استنباط نموده اند و اختلاف فقط در اعراب واژه می باشد.

چکیده [English]

The syntactical interpretation of the Quranic verses and the difference in syntactic aspects is one of the topics that has always caused a difference of opinion in the derivation of jurisprudential rulings, and a difference in the perception and understanding of the commentators, translators and jurists of the Quranic verses. In this article, based on the syntactical interpretation of the verses and reference to noteworthy syntactic aspects, the verses of Al-Ahkam are examined, and with an analytical-descriptive view, the possibility of receiving new inferences from jurisprudential rulings is investigated. And by answering the question whether it is possible to derive a new jurisprudential understanding of Ayat al-Ahkam on the basis of syntactic interpretation, different viewpoints have been explored. And the result is that in some of these verses, the differences raised by grammarians, although in some cases, are minor.But it is so important that the jurisprudence of each jurist is completely different from that of his class, and in another part of the verses, the difference is only in the interpretations proposed by grammarians, which does not have a significant effect on acts and religious obligations. In other words, all the jurists have deduced the same ruling and the difference is only in Arab words.
